Dear Editor: Last Friday, Dec. 1, I replaced one of my stolen Liberty Signs on one of my trees on Somerville Road near Allen Road (STOP ANARCHY ? OBEY OATH CHIEF KELLY ?TRAITOR). This time I anchored it ten feet above the ground but as I rounded the corner on my way to church yesterday I found that it had already been stolen ("after 4:30 P.M. on Friday" from neighbor into Police Report). On Sunday I also notified the Police that a radio jamming signal had appeared and was jamming me when I turned on my radio station early Sunday morning. I soon learned that it was not, as usual, coming from ?hundreds of miles away but was quite local. I did not have time to investigate it before church but when I returned home I quickly located the jamming radio station. It was on the English property south of Allen Road. I left it ?intact while I engaged a neighbor as a witness. When the Policeman arrived I specifically told him that it was an inter-State matter and that I first ?wanted to present the evidence to the Federal Communications Commission. He ?accepted that so I then divulged the location of the evidence. My neighbor and I were stunned when the Policeman then very ?quickly confiscated the evidence and would not even allow us to look at it a few hours later I received a visit from a man from Maine whom I had never met before. He has been listening to my radio broadcasts for decades and when he saw the "Liberty Corner" sign along Route 287 he decided to look me up to give me a 'vote of confidence' . Thanks to my friends at the Liberty Corner Church he found me. He regularly hears my persecutors from across eastern America and Canada. Your humble servant, Irwin L. They criminally destroy my most productive sugar maple trees and then declare, "Oh you now no longer qualify for farmland (open spaces) assessment ". Now I read in your Nov. 16 issue that they are preparing to usurp my venison harvesting enterprise and again will declare, "Oh since you no longer harvest ' five to twelve venison per year' you no longer qualify for farmland assessment ". You might recall that in one of my letters a year or two ago that ?shirked one of my farming duties and engaged a B.T. Policeman to dispatch a deer which was on that controversial "one half acre of land around my farmhouse' which for over one decade Bernards Township has sworn under Oath that I "do not use for farming" (not to mention my honey bees which have dwelt within the walls of the old farmhouse for almost one quarter of a millennium). For a good part of this twentieth century my private enterprise venison harvester has been doing an admirable job and it has not cost the 'slaves' one cent. That word "subsidy" should be banished from America! It is a synonym for "slavery"! ?("English Law. Dear Editor: Please let me further amplify on the gross voter fraud and voter conflict of interest ?which is rampant in our country today. When we vote we should only be permitted to use a pencil and a piece of paper. If we don't know what to do with them we should not be ?voting but alas today we are hard pressed to find people who are qualified ?to count "ballots" (Art. II, Sec. 1, Par. 3, United States Constitution). In our " union" of ?sovereign "States" we are to have three types of electors. They are not to be labelled 'college', 'university', 'institute' etc. One type of "electors" (Art. I, Sec. 2, Par. 1) are to elect ?members to the House of Representatives who are bound to represent ?we-the-people. Each one is to represent in the vicinity of "thirty thousand people" (Art. 1, Sec. 2, Par. 3). Today we no longer have representation since no mortal can represent over six hundred thousand people! "Representatives and direct taxes shall be apportioned according to the census (Art. I, Sec. 2, Par. 3). The next type of electors are those who elect the Senators (Art. I, Sec. 3, Par. 1) who are to represent the Sovereign States. If the ?States should become Satellites, Soviets, Colonies etc. then the United ?States would no longer exist!!.' The third type of "electors" ?(Art. II, Sec. 1, Par. 2) are those who are to elect The President who is to represent The "Union" ?(Preamble) of Sovereign States. If that procedure fails then each Sovereign ?State. is allowed to cast one vote for The President (Art. II, Sec. 1, Par. ?3) thus little Rhode Island has equal ?representation in the "Union". When Jefferson was elected President the tie vote between the ?States was broken when Liberty Corner farmer Alexander Lynn cast his vote for Jefferson! ! !! ! Concerning voter "conflict of interest" Article II, Section 1, Paragraph 2, U.S.C. clearly orders that no electors shall be ?allowed to vote who accept. "profit" from The United States. Thus people in the ?Military, people who receive Social Security Insurance checks etc. etc. ?should never be allowed to vote. School teachers who teach in "public" schools ?should be allowed to vote but teachers in ?government" schools should never ?be allowed to vote'.' Government schools are illegal (Art. IV, Sec. 4)! Oh how Blessed we are that The Father of The United States Constitution, James Madison, spent the four most informative ?years of his Life not far from Liberty Corner and that during The ?Constitutional Convention he delivered a scathing denunciation of ?"Democracies"! Any 'American' who refers to our form of government (Art. IV, Sec. 4) as a "Democracy" should be cited for "treason" (Art. III, Sec. 3)! I am sorry to say that I find something 'fishy' in your letter: "Bernards Township's offer to plant 10 large trees along the ?right-of-way ?adjacent to your property on Somerville Road." As the records reveal, and is now quite visible, you shifted the road right-of-way onto my property to accommodate your 'kiddie trail' ?on the other side of the road. At the south end of my property the right-of-way is exactly where it has been for centuries. At the north end of my property the right-of-way is exactly where it has been for centuries. Between there your ?new ?right-of-way line is at the edge of your new roadway EXACTLY AS IT IS ALONG THE TOTAL LENGTH OF MY PROPERTY ALONG SOMERVILLE ROAD! Have you paid me and my neighbors to the north on Somerville Road for new right-of-way ?line behind the centuries old one?!!! Holmes was severely wounded several times while murdering his brothers during the Civil War. In my Feb. 25, 2000 letter to Bernards Township Court Judge ?Kelleher I cited several vital discrepancies in his conviction of me (burning of plant life while celebrating the birthday of The Bill of Rights). It ?revealed that he very illegally sentenced me to slavery ("community service") while he Swore that only criminals may be subjected to slavery and other forms of involuntary servitude (Article XIII, U.S. Constitution)! When I was a young man there were some male homo sapiens who would bleat, "Let us join in with this government purchase, this creeping socialism (nazism), Marxism, communism, King George and Caesar's insurance policy" but the Americans would answer and shout the Patrick Henry response, "Better dead than red!" Re: Summons #1999 3021 Dear Mr. Keileher: I am enclosing copies of my two page Brief and "unreasonable search" plea of Feb. 22, 2000. At the end of page two you will note , "I also add my plea of recusation against you and the Court". Judge Pollock did profusely apologize for his conduct on Jan. 11, 2000 but he refused to recuse the Court. The Prosecutor told you that "quacky criminal" ("quasi criminal") charges are "not criminal" but as I am sure you know, whatever adjective you put before "criminal" it is still "criminal". The Grand Jury could and should laugh all of these 'quacky criminal' cases out of the County then our Courts would not be in a 'log jam'.($$$!) I hope that you realize that my "crime of "burning plant life in an open fire" (such as smoking tobacco) is as with Article XVIII of the U.S. Constitution, we never obey illegal laws! Feb. 29, 2000 Dear Public Servants: For several decades I have been a victim of spiteful criminal conduct at the hands of Bernards Township. The corner of Allen and Somerville roads exhibits a decade old monument to that continuing spiteful criminal conduct of which ?alluded when I accused superior Court Judge Diane of being a criminal at the December 1998 Hearing. At that Hearing Peter ?Messina falsely swore that he had to take my property because of a "specimen" tree across the road. While under Oath he could not answer what specimen or species it was and how wicked it is that you accuse me of tapping "oak trees"! Peter Messina lied when he swore that my neighbor's tree was the cause of his taking of my property! The thirty-three feet right-of-way was between my neighbor's wood rail fence and my barbed wire fence and it is very easy to build a thirty two foot road within a thirty three feet right-of-way. How wicked it is that you shifted the road away from your Bernards Township acreage and took my precious property! On January 11, 2000 I gave to you a further report on your continuing spiteful criminal conduct against me. On November 27, 1999 my neighbors Debbie Weisman and Joe Dupont stopped by to inform me that you ?had raped a great number of my trees behind that so-called "red stake line" of October 13th. While we were out there surveying your spiteful criminal conduct one of your police cars (which have been religiously patrolling that ?unused road since October 13) passed by but he refused to get out of his car to witness what Debbie and Joe and I were witnessing. I rarely go out to Somerville Road to witness what you have done there but I have here thirteen pictures which I took out there on January 9th with Lucy Bare as a witness. #1 shows the unchanged telephone pole on the old right-of-way near Allen road. It is diagonally across from the "specimen tree" at which point you cut the road into my property. Lucy is standing behind the ?stump of a once gorgeous large red cedar tree. It was well behind the right-of-way and the curb. Now please compare that with picture #2. #2 shows a much smaller red cedar tree on the Braden property which you well protected even though it is much closer to the curb. #3 was taken at the north end of my property where your curb is on the old right-of-way line. Lucy is standing behind the stump of a once gorgeous huge white oak tree which was thirteen feet behind your curb ?I have many pictures which show the many trees which you spitefully and criminally cut and uprooted behind your curb! #4,5&6 are more pictures which show how careful you were with my neighbors" trees between Far Hills road and Albrook School. Dear Tom: Recently the mentality of Bernards Township was exposed when I was ordered to appear at your Court on one of the most Sacred Holidays, George Washington's Birthday, to answer your charges that my Bill of Rights Birthday Liberty Bonfire was illegal! As you have perhaps read in The Bernardsville News or elsewhere your "arms detector' is nauseating to me in more ways than The reason that you, our public servants, put it there is because you are scared of we-the-people, don't trust us and regard us as a threat. How illegal and revolting it has been for some time when you stationed your armed men at the locked Town hall doors as long lines of us waited while the Township Committee conducted SECRET meetings inside (Art. Now you cause even more long lines by installing your odious "arms detector"! The last time I was there I had made sure that I was not carrying any metal on my person yet your alarm went off and then your armed ?men suspiciously spent much time rubbing a hideous electronic device all over ray private 'Temple' (my body). These are all exercises in ANARCHY with a total disregard for the "supreme law of the land" (Art. VI, U.S.C.)! Are you now going to install "arms detectors" at all Township gatherings and intersections?! ("He has erected a multitude of new Offices, and sent ?hither swarms of Officers to harass our people, and eat out their substance.")! The idea that we-the-people& are disarmed while the Judge, the Township Committee and you are armed to the teeth and not required to submit to your obnoxious "arms detector" smacks of a totalitarian form of government totally contrary to your Sacred Oath. Several weeks ago while on vacation near Vermont I learned that their State Legislature. was considering the legalization of sodomy and I then wrote to them that my 1958 Webster's Dictionary defined "sodomy" ?as a "crime". Now the sodomites and Semites are angry at me because I am quoting the definitions of words. I now have for you another word definition which I have been quoting of late. It is "Persecute, to afflict constantly so as to injure or distress, as because of one's religion, beliefs, etc." If you in your position accuse me of being anti-semetic or anti-sodomite you are persecuting me. You are not to be intimidating me from expressing my beliefs, opinions etc. in public. You are paid to express your beliefs and opinions in public. In America we should be encouraged to exercise that great right and privilege. Even before we go into the voting booth we should express opinions. My opinion is that presidential candidate Alan Keyes has the right opinions. I hope that you don't now accuse me of being anti-white because Mr. Keyes is a black man! JACOB PERRY Staff Writer Bernardsville News 908 766 3900 BERNARDS TWP. - Irwin Richardt of Liberty Corner was fined but avoided jail as a Municipal Court judge made a split ruling Tuesday on charges that Richardt interfered with township efforts to widen a road along his property. Judge Robert Pollock, whose ruling followed a two-and-a-half hour trial, found Richardt's guilty of interfering with a government function for having pulled out surveying stakes along Somerville 'Road. He acquitted Richardt on a charge of defiant trespassing. The conviction carried a potential fine of $1,000 and up to six months in jail. Pollock opted for a fine of $300, plus $155 in miscellaneous costs and fines, and he suspended a 20- day jail sentence on the condition that Richardt not interfere further with the road project. In an interview afterward, Richardt reciteted 'his belief that the" township could not condemn any portion of his property without giving him a trial by jury. "The whole thing is very demoralizing because our Constitution and the New Jersey Constitution are so plain that an 8-year-old child can understand them," he said. "I don't have to hire a wizard to gain those rights," he added. "Our whole judicial system is based on a right to a trial by jury." As to whether he would appeal, Richardt said, "I'm appealing to, the jury, We the People." The case has drawn widespread attention and led Richardt to receive a record-breaking 532 write-in votes for the Township Committee on Nov. 2. Richardt, who is well-known locally for his strict adherence to the U.S. Constitution, has vehemently objected to the township's taking of his land. The township condemned a seven-foot-wide strip of Richardt's 22.5-acre Sons of tiberty Farm as (Please see Fine on page 2.) Continued from Page 1 part of its plan to widen Somerville Road. After contractors arrived on Oct.13, Richardt allegedly tossed three surveying sticks into the road. He was arrested, charged and released on $1,000 bail. At the start of Tuesday's trial, Richardt read a statement in which he accused the court of ?"shabby conduct" and "malfeasance," saying he never received notice of the trial date and had learned about it through the grapewine." He criticized his bail as excessive. "Every township policeman knows I am of infinitely higher character than former Somerset County Prosecutor Nicholas Bissell," he said, referring the late convicted felon. Richardt added that many people had offered him tips on how to "beat" the system. "I am not here to beat the system," he declared. "I am here to restore the system." A recess was later called to allow Richardt's court-appointed attorney, Brian Sige of Somerset County Criminal Case Management, to confer with him. Sige said he had written to Richardt the previous Thursday but received no response and had just met him. When the trial resumed,, Sige said Richardt wanted a postponement and also wanted Pollock ?recuse himself because he was a township employee. The judge denied both requests. The trial then proceeded, with the township calling seven witnesses - Township Engineer and Planner Peter Messina, Township Attorney John Belardo, police Lt. Dennis Sakos, Michael Somerday, a construction foreman for the contractor, ?Patrolman ?Daniel Snyder, Patrolman Hank Warner and police Lt. James Anthony. There were no witnesses for the defense. After the testimony, Sige asked to have the charges dismissed. Richardt had tossed the stakes from land he genuinely thought was still his, Sige said. Pollock denied the request. The judge found Richardt guilty of interfering with a government function. He said the tqwnship had legally condemned the land and that Richardt's purpose in tossing the stakes was to interfere Pollock dismissed the charge of defiant trespassing, saying police on the scene had only told Richardt not to touch the stakes. In issuing a sentence, Pollock acknowledged Sige's argument that Richardt should not be jailed because the project has been allowed to proceed. Municipal Court Judge Robert Pollock fined Richardt $300, plus another $155 in court costs and fees, for interfering with a construction crew staking out land for a township road project in October. But Pollock cleared Richardt of dispute over the widening of Somerville Road from 18 feet to 32 feet in Liberty Comer. The road serves The Hills, a sprawling development that extends from neighboring Bedminster. It needed to be widened and bicycle paths added for safety, township engineer Peter Messina testified. Richardt, who lives a Spartan lifestyle on his 22-acre property, objected to the loss of a strip of road frontage - 7 feet by 400 feet - for -I the widening. With a Jeffersonian view of individual rights, Richardt argues that the taking is only legal if approved by a jury. "I was engaged in protecting and defending my property" by removing stakes placed to mark the new course of the road, Richardt said. Bernards police arrested him and ball was set at $1,000, "although they all know that the last place I would flee from is Liberty Comer," he said. That's not the way it works, P01-"defiant trespass" for objecting to the work while standing on land seized from him by the township through eminent domain. In between, Richardt and the judge lectured each other on the Constitution, the oaths local officials take to uphold the law and the responsibilities of citizens to respect the public good. The right to a jury trial, protection from unreasonable seizure and freedom of speech all figured in the lock said, after Township Attorney John Belardo and others testified about the legal process Bernards went through last year to condemn the land, notify Richardt, get approval from the late Superior Court Judge Wilfred Diana and set aside $6,000 for the acquisition. "This court is compelled to apply existing law in this state," Pollock said. His constitutional arguments quashed, Richardt initially refused to participate in the hearing. But attorney Brian Cige, appointed by the court because Richardt did not waive his right to representation, frequently huddled with him and questioned township witnesses. Under his cross-examination, local police and others testified that Richardt only had been told not to pull up stakes for the road project, not to leave the area. In the end, Pollock gave Richardt another lecture, saying, "The expression of constitutional rights cannot be unlimited to gratify the self" without consideration for citizens' responsibilities. The judge could have set penalties of up to $1,000 in fines and six months in the county jail. "I'm appealing," said Richardt (908 647 1196). With fall colors beginning to flame in the foliage, Richardt sought to protect a line of sugar maples from the township's plan to widen Somerville Road. After a contracting crew planted orange stakes amid the trees, Richarrit followed, pulling up the markers while engaging police in a debate about the Founding Fathers' legal intentions. For the second time in a decade, the township has used eminent domain to take a piece of Richardt's Sons of Liberty Farm, a bucollc tract that recalls Bernards' colonial past,not its rapidly developing present. The 22-acre tract includes Richardt's 1800s house, clapboard on a log foundation, along with the maples that he taps for syrup as well as many other trees. But the land also is embroiled in a 20th-century controversy, in the form of The Hills development. The 2,600-umt suburb, which sprawls across the border from neighboring Bedminster, has an entrance on Allen Road opposite ?Richardt's property. Last year, now-de-ceased Superior Court Judge Wilfred Diana allowed the township to take a 7-foot strip along 400 feet of Richardt's frontage on Somerville Road. Richardt described that rulling and a previous one giving the township a similar bite along Allen Road as "absolutely contrary to the Constitution." Thesday night, he went to the township committee to restate his position that Americans "shall never be deprived of property except by a jury". "Property rights are the foundation of our system," Richardt told Officers Dan Snyder and Henry Werner, pressing copies of the Constitution on them. "You're putting us in an awkward position," Werner said, as Richardt kept purnng up stakes. It got even more awkward when Richardt asked to see their authoriza- tion to take the property. "All of the paperwork is back at the township building," said police Lt. James Anthony. Richardt pulled up another stake, Anthony reluctantly ordered his arrest. "I respect his position, but recourse isn't in the street, it's in the courts," the lieutenant said. Police at the scene declined to say what charges, if any, they would file, and a desk officer said later, "I don't know what you're talking about." "They charged me with trespassing on my own property, if you can believe it," Richardt said last night. "They didn't have any paperwork at the scene, but when I was in jail, they showed me a document dated October 1998, and the hearing before Diana wasn't until December," he said. After a telephone conference that he was excluded from, Richardt said, his bail was set at $1,000. The Rev. ? Norman Dietsch, pastor of the Evangelical Fellowship Chapel, put up the money, Richardt said. "It is his livelihood; he does make maple syrup" from trees being taken for the road widening, Dietsch said. "If they would give him just compensation, it would be different." During my almost three quarters of a century on this earth I have never committed a crime and I do also believe that I am fairly spotless in the sin department. I have never been married which includes never having had a one night heathen marriage. I drove my many motor vehicles for well over one million miles without one single Summons nor one accident. In all of those miles I never once engaged in 'speeding' etc. Many years ago the I.R.S. did harass me for a short while during which time one of their agents confided in me that he was stalking me through Bernardsville one day and learned that I was a very law abiding man and "even stopped at all 'stop signs'". He then asked me why it was that such a law abiding man disobeyed their I.R.S. ordinances. I then gave him a 'crash course' in what it was that he took a Solemn Oath to obey. He immediately understood what I was talking about and he apologized when he departed. I was never again visited by I.R.S. agents because I was a 'bad' influence on them. Tonight I am charging you with being criminals and I here recommend that you not be released on bale. Please turn off your silly illegal five-minute-timer. I am here to duly iridict you and there can be no time limit on that. I cannot begin to list the myriad of criminal harassments which you perpetrated against me during the past one third century thus I shall only pick out some of the more recent ones. Over one decade ago you sent me to jail for three months while admitting that I had not committed a crime and after you took an Oath that Irwin Richardt shall never be sent to jail excepting if he had been duly convicted of a crime by a jury (Articles XIII and VI, U.S. Constitution Bill of Rights). About one decade ago you Swore while under Oath before the Somerset County Board of Taxation (and the ensuing year) that you had documentation which revealed that I do not farm one half acre of my land. On both occasions you Swore that such documentation was back at the Town Hall and that you would send copies to me and the Board of Taxation. Now one decade later I am still waiting for those promised documents. Earlier this year when we again went through the same scenario before the Somerset County Board of Taxation you again Swore that you forgot to bring that vital documentation and again Swore that you would send a copy to me. When you arrested me on October 13 I again asked you to please show me the documentation concerning your theft of my land and again you Swore, "We did not bring it along with us. It is in the Town Hall." Later that day when you had me incarcerated here in your jail I said to you, "Well, now that we are at Town Hall please show to me that Sworn to document. After several hours of requesting and badgering you finally showed to me a document dated October 7, 1999 which was long before the so-called "Hearing" into the matter before the N.J. Superior Court just prior to Christmas of 1998! Page Two 10/26/99 About one decade ago you indicted me with a Show Cause Order as to why some of my property at the corner of Somerville and Allen roads should not be taken by you through eminent domain. It seems that the best kept secret of the decade has been the fact that I won that Case and that I still own that land today which is indelible proof that about one decade ago you committed a crime when you needlessly, maliciously and criminally filed eminent domain charges against me! I have further criminal charges against you in that Case since at that time you needlessly, maliciously and criminally raped many of my gorgeous trees from that land which I still own today! Your initial claim in your more recent eminent domain charges against me was that you had to take my land along Somerville road for a "bike trail". Since that was totally false and ridiculous you dropped that one long ago. When I had the pleasure of cross examining you at the New Jersey Superior Court 'Hearing' last December you Swore that you were taking my land so as to protect the Neuman's "historic house' on the other side of the road. That is evil and I suspect criminal! When I spotted those red stakes on my property on October 13 I saw that you were doing the same thing that you had done about ten years ago at the corner of Allen and Martinsville roads when you condemned the beautiful farmland on the north side of Allen Road to protect the Ingersoll Rand 'historic house' on the other side of the road. In both instances the roads were straight and you designed curves into them so as to protect your "historic houses" at the expense of the precious vanishing farmland. The tragedy of this whole issue is that it is a non-issue. To wit:Somerville road has been a thirty three feet wide dirt road for centuries until some years ago when it was paved but not to the full width. Now you are proposing to re pave Somerville road but again NOT to the full width. Thus there is no issue! Now we come to the matter of the two checks which you have claimed to have sent to me. The October Star Ledger reported that Mayor Boquist "said the Township issued a $7,000 check for the land, although Richardt never cashed it." Anyone who says that I received such a check is lying! About ten years ago you also said that you gave to me a similar check which again I never received.
